There are some laws you need to consider before sending Marketing campaigns.
Below are highlights about CAN-SPAM and CASL. We recommend investigating more about local and international laws to best understand the full details that apply to your business.
CAN-SPAM
The CAN-SPAM Act (Controlling the Assault of Non-Solicited Pornography And Marketing Act) is a U.S. law that sets the rules for commercial email, establishing requirements for commercial messages, giving recipients the right to have emails stopped from being sent to them, and spelling out tough penalties for violations. Key provisions include:
- Clear Identification: Emails must clearly identify themselves as advertisements.
- Accurate Information: The “From,” “To,” and routing information must be accurate and identify the person or business who initiated the message.
- Opt-Out Mechanism: Emails must include a clear and conspicuous way for recipients to opt out of receiving future emails.
- Prompt Compliance: Opt-out requests must be honored within 10 business days.
This act aims to protect consumers from spam and ensure that commercial emails are sent responsibly.
Canada's Anti-spam Legislation (CASL)
CASL (Canada’s Anti-Spam Legislation) is a law designed to protect Canadians from spam and other electronic threats. Key points include:
- Consent Requirement: Businesses must obtain explicit or implied consent before sending commercial electronic messages (CEMs).
- Identification Information: CEMs must clearly identify the sender and include contact information.
- Unsubscribe Mechanism: CEMs must provide a clear and easy way for recipients to unsubscribe from future messages.
- Record Keeping: Businesses must keep records of consent and unsubscribe requests to demonstrate compliance.
CASL aims to reduce spam, protect privacy, and promote the efficient use of electronic communications.
